SchLuing Company LLC, doing business as EJ Family Auction (“EJ Family Auction,” “we,” “us,” or “our”) operates an online multi-vendor auction marketplace at ejfamilyauction.com. By accessing or using our platform — whether as a buyer, seller, or visitor — you agree to be bound by these policies and terms.

EJ Family Auction is a marketplace platform. We facilitate transactions between independent sellers and buyers. We are not the seller of any item listed on our platform unless explicitly stated. Each seller is responsible for the accuracy and quality of their listings.

We reserve the right to update these policies at any time. Continued use of the platform after any change constitutes your acceptance of the updated terms. The most current version will always be available at ejfamilyauction.com.

To register for an account and participate in auctions you must be at least 18 years of age. By creating an account, you confirm that you meet this requirement. EJ Family Auction reserves the right to verify age and identity at any time and to suspend or remove accounts that do not meet eligibility requirements.

All bidders must create a registered account and have a valid credit or debit card on file before placing any bid. Guest bidding is not permitted. This requirement ensures accountability and protects sellers from non-paying bidders.

A valid credit or debit card must be saved to your account before bidding. By saving your card you authorize EJ Family Auction to charge your card in the event you win an auction. Your card information is encrypted and processed securely through Stripe — we never store your full card details on our servers.

All bids are legally binding. When you place a bid you are entering into a contract to purchase the item at that price if you are the winning bidder. Bids cannot be retracted or cancelled once placed.

Important: Do not bid on items you do not intend to purchase. Placing bids without the intention to pay is a violation of these terms and will result in permanent account suspension.

EJ Family Auction offers proxy bidding, which allows you to set a maximum bid amount. The system will automatically bid on your behalf up to your maximum, increasing your bid only as needed to maintain the winning position. Your maximum bid amount is kept confidential from other bidders and sellers.

To ensure fair competition, any bid placed within the final 60 seconds of an auction will automatically extend the auction by 60 seconds. This gives all interested bidders a fair opportunity to respond and prevents last-second sniping.

Each auction has a minimum bid increment set by the seller. New bids must meet or exceed the current bid plus the stated increment. The minimum increment for each listing is displayed on the auction page.

Some auctions may have a reserve price — the minimum amount the seller is willing to accept. Reserve prices are not disclosed to bidders, but the auction page will indicate whether the reserve has been met. If the reserve price is not met at auction close, the item will not sell and no charges will be made.

All auction end times are based on server time. EJ Family Auction is not responsible for any discrepancies between a bidder’s local device time and server time. We recommend confirming auction end times on the listing page directly.

Registered users may add items to their watchlist to track auctions they are interested in. Adding an item to your watchlist does not place a bid or create any obligation to purchase.

When an auction closes and you are the winning bidder, your saved payment method will be automatically charged for the total amount due — including the winning bid amount plus the 15% buyer’s premium. No additional action is required from you to complete payment.

Example: You win an item with a final bid of $100.00. Your card will be automatically charged $115.00 ($100.00 winning bid + $15.00 buyer’s premium).

All purchases are subject to a 10% buyer’s premium added to the final winning bid price. This is charged to the buyer at checkout and is clearly displayed on every auction listing. The buyer’s premium is non-negotiable and non-refundable.

We accept all major credit and debit cards (Visa, Mastercard, American Express, Discover) as well as Apple Pay and Google Pay. All payments are processed securely through Stripe.

If your card is declined at the time of automatic charge, you will be notified by email and given a 24 hour window to update your payment method and complete the transaction. Failure to resolve a declined payment may result in account suspension and the item being relisted.

Failure to complete payment in 48 hours for a won auction item, will result in permanent account suspension. The item will be relisted for sale. EJ Family Auction reserves the right to pursue any additional remedies available under applicable law.

All Sales Are Final. EJ Family Auction operates on an all-sales-final basis. We do not accept returns or issue refunds except in the specific circumstances outlined below.

By placing a bid and winning an auction, you agree that the sale is final. We strongly encourage all bidders to review listing photos, descriptions, and any available video carefully before bidding. If you have questions about an item, contact us before placing a bid — not after winning.

A refund or dispute resolution may be considered only in the following circumstances:

• The item was not received and the seller cannot provide proof of availability for pickup.
• A duplicate charge or technical error occurred during payment processing.
• To request a dispute review, contact us at [email protected] within 48 hours of your scheduled pickup. Include your order number, a description of the issue, and supporting photos where applicable. Each dispute is reviewed on a case-by-case basis and EJ Family Auction’s decision is final.

Sellers are required to accurately represent item condition. All items are considered as used condition unless stated otherwise. If an item is found to be significantly misrepresented, EJ Family Auction will investigate and may issue a full or partial refund at our discretion. Sellers found to be deliberately misrepresenting items will be permanently removed from the platform.

EJ Family Auction is a local marketplace serving the Fargo / West Fargo, North Dakota and Moorhead, MN surrounding areas. All items are available for in-person pickup only. We do not offer shipping. By bidding on any item you confirm that you are able to arrange local pickup.

After winning an auction and completing payment, the seller will contact you to arrange a pickup time and location. Pickup logistics are coordinated directly between buyer and seller. EJ Family Auction facilitates the transaction but is not responsible for scheduling or transportation.

Buyers are expected to arrange and complete pickup within a reasonable timeframe as communicated by the seller — typically within 7 days of auction close unless otherwise agreed. Failure to arrange pickup within the stated timeframe may result in forfeiture of the item with no refund.

Buyers should inspect all items at the time of pickup. By accepting an item at pickup, the buyer acknowledges that the item matches the listing description and confirms the transaction is complete. Post-pickup disputes regarding item condition will not be considered.

All sellers must apply and be approved by EJ Family Auction before listing any items. We reserve the right to approve or deny any seller application at our discretion. Approval is not guaranteed and may be revoked at any time if a seller violates these policies.

Sellers are responsible for providing accurate, honest, and complete descriptions of all items. Listings must include clear photos and must not misrepresent condition, authenticity, age, or any other material attribute of the item. Misleading listings are a violation of these terms and may result in immediate account suspension.

• Clear photos of the actual item being sold (stock photos are not permitted)
• Accurate description of item condition (New, Used, etc.)
• Honest representation of any defects, damage, or wear
• Realistic starting bid — sellers may set a reserve price if needed
• Items must be available for local pickup in the Fargo / West Fargo area

All new listings are reviewed by EJ Family Auction before going live. We reserve the right to reject any listing that does not meet our standards, violates these policies, or includes prohibited items. Approved listings go live immediately after review. After a seller’s first 2 auctions, requests to have listings automatically listed may be granted. 

Sellers are charged a premium on each successfully completed sale. The premium is deducted automatically from the seller’s earnings balance. See the Fees & Commissions section for current rates.

Sellers may request a withdrawal of their earnings balance at any time, subject to a minimum withdrawal amount of $50.00. Payouts are made via bank transfer and a 3.2% processing fee is applied at the time of withdrawal. This fee covers Stripe’s payment processing costs. Payouts typically arrive within 2–5 business days.

Sellers are solely responsible for the accuracy of their listings, the condition of items sold, and the completion of pickup arrangements with buyers. EJ Family Auction is a marketplace facilitator and is not responsible for disputes arising from seller misrepresentation.

EJ Family Auction reserves the right to suspend or permanently ban any seller account for violations including but not limited to: misrepresentation of items, failure to honor completed sales, repeated buyer complaints, or listing prohibited items.

EJ Family Auction charges the following fees. There are no listing fees — you only pay when an item sells.

Seller/Vendor Fees:

EJ Family Auction reserves the right to update its fee structure at any time. Sellers will be notified of any fee changes with reasonable advance notice. Changes do not apply retroactively to completed sales.

The following items are strictly prohibited from being listed on EJ Family Auction:

• Illegal items of any kind under federal, state, or local law
• Weapons, firearms, ammunition, or dangerous materials
• Counterfeit, fake, or replica items represented as authentic
• Stolen property
• Hazardous materials or substances
• Adult content or materials
• Live animals
• Items that infringe on intellectual property or trademark rights
• Any item whose sale is restricted or regulated by law

The following conduct is strictly prohibited and will result in immediate account suspension:

• Bid manipulation, shill bidding, or colluding with others to manipulate auction outcomes
• Creating multiple accounts to circumvent bans or policies
• Harassing, threatening, or abusing other users
• Providing false information during registration or in listings
• Attempting to conduct transactions outside the EJ Family Auction platform to avoid fees
• Any fraudulent activity including payment fraud or identity theft
• Shill bidding — placing bids on your own listings or having others bid on your behalf to artificially inflate prices — is a serious violation and may constitute fraud under applicable law. Any account found engaging in this practice will be permanently banned and reported to relevant authorities.

When you create an account or make a purchase, we collect information necessary to operate our platform including your name, email address, billing address, and payment information. Payment details are processed and stored securely by Stripe — we do not store full card numbers on our servers.

• To process transactions and facilitate auction activity
• To send auction notifications, outbid alerts, and winning notifications
• To communicate with you about your account or orders
• To maintain the security and integrity of our platform

We do not sell your personal information to third parties. Buyer contact information is shared with sellers only to the extent necessary to arrange pickup of won items. We use Stripe for payment processing — their privacy policy governs the handling of your payment data.

Buyer personal details are hidden from sellers in the seller dashboard. Sellers receive only the information necessary to coordinate pickup — typically the buyer’s name and contact email after a completed transaction.

SchLuing Company LLC, doing business as EJ Family Auction, is a marketplace platform that facilitates transactions between independent buyers and sellers. We are not a party to any transaction and make no warranties regarding the quality, safety, authenticity, or legality of items listed by sellers.

To the maximum extent permitted by applicable law, SchLuing Company LLC shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of our platform, including but not limited to:

Disputes between buyers and sellers

• Item condition discrepancies
• Failed or delayed payment processing
• Technical outages or platform unavailability
• Loss of data or unauthorized account access

Our total liability to any user for any claim shall not exceed the total fees paid by that user to EJ Family Auction in the six months preceding the claim.

These terms and policies are governed by the laws of the State of North Dakota. Any disputes arising from use of this platform shall be resolved in the courts of Cass County, North Dakota.

These policies constitute the entire agreement between you and SchLuing Company LLC d/b/a EJ Family Auction regarding your use of our platform and supersede any prior agreements or understandings.
